The Bayhome Studios (BHS) eListing service may only be used to represent residential or commercial property for sale or rent. Upon purchase of an eListing, you agree to pay BHS the appropriate fee. The eListing is not refundable once the domain name has been registered.

Grant of License. BHS grants the User a non-exclusive, non-transferable license to use its eListing software. The User may not use or duplicate the software. eListings shall be used for lawful purposes only and shall not be used by anyone to post, propagate, distribute, publish, house, store, solicit, process, transmit or otherwise handle any Unacceptable Material including but not limited to: Obscene, Discriminatory or Harassing, Defamatory, Fraudulent, Hate, False Advertising, Violations of Intellectual Property Rights, Spam, and Systems Abuse.

Limitation of Liability. BHS shall bear no responsibility or liability for the content of any Web page hosted by BHS and its affiliates. BHS does not pre-screen, review or monitor the data, information or other materials that appear on the web pages. Any opinions or views espoused on any web page hosted by BHS or its affiliates do not necessarily reflect the opinions or views of BHS.

Responsibility for Content. As the author of any and all web pages hosted by BHS and its affiliates, the User acknowledges he is fully and solely responsible and liable for the content of the website, and represents and warrants that: 1) You have permission from the homeowner/seller to place information concerning the property on this internet site. You agree to indemnify and hold BHS and its affiliates harmless from any and all claims of the homeowner/seller arising out of or in connection with the placement of the property information on the website. 2) The information regarding any properties that you place is accurate and correct to the best of your knowledge and belief and that you have verified this information in accordance with the present custom and practice in the industry. You agree to indemnify and hold BHS and its affiliates harmless from any and all claims of injury and/or damage arising out of or in connection with the accuracy of information on the website. 3) You have been authorized by your employer and/or the owner of the name, service mark/trademark/logo to place its name/service mark/trademark/logo on any of your web pages. You agree to indemnify and hold BHS and its affiliates harmless from any and all claims by such entity relating to the placement of its name/service mark/trademark on BHS products. 4) You own or otherwise control all of the rights to the content or that the content is in the public domain and that public posting and use of your content by BHS will not infringe upon or violate the rights of any third party. 5) It is your responsibility to determine if any of the images on the site are copyright protected.

Representations and Warranties. BHS cannot guarantee uninterrupted service nor will it be responsible for compatibility with all systems and browsers.

Intellectual Property Protection. eListing software is intellectual property of BHS. This Agreement does not give the User any intellectual property rights in the Software.

Termination. BHS reserves the right to suspend and/or terminate the User’s account and Services provided by BHS (subject to any applicable fees and charges including termination fees) if it determines, in its sole and absolute discretion, that the User is in violation of this User Agreement and shall report any illegal activity to the appropriate authorities. Upon termination, the User’s domains will be deactivated and all traffic will be rerouted to BHS.
